If it is an error on your financial assessment please submit documents proving the accurate income information prior to submitting a Request to Review form. We operate and provide legal counsel free from outside involvement. As a registered society incorporated under the provincial Societies Act, Legal Aid Alberta is an organization independent from government, but is accountable to the Minister of Justice and to the Law Society of Alberta. You will be asked for information and documents related to your situation, such as your relationship to the respondent, details of the violence, and any supporting evidence.

We can help with child welfare matters if your child has been taken away and you have been served with a temporary or permanent guardianship order. In addition, if child protective services have served you with a supervision order application, we can assist you. Reporting to the board of directors, John is responsible for the executive planning and coordination of the organization. He also represents the organization in dealing with Alberta Justice, the Law Society of Alberta, the federal government, other legal aid plans in Canada, the legal community, and the public.
Once financial eligibility is confirmed, our staff lawyers will review your case to ensure it meets LAA’s criteria for civil matters. Legal aid duty counsel lawyers are in courtrooms across Alberta to provide immediate legal information, advice and assistance to unrepresented people. This is possible because we have a network of 1,200 roster lawyers who take legal aid cases. Roster lawyers are practice practice lawyers who play a crucial role in serving disadvantaged Albertans, especially in remote communities. Duty counsel are lawyers that are employed by Legal Aid Alberta who help people understand the court process and who give free legal advice to people representing themselves at their first court appearance.

If the Court schedules an Oral or Viva Voce Hearing after the Review Hearing, full legal representation is required and LAA’s financial eligibility guidelines will apply to both claimants and respondents. LAA will ask you a few questions about your income, assets and expenses to confirm your financial eligibility. Due to changes in the court processes and a focus on mediation prior to taking court action, most clients applying for family matters are referred to free resolution services through the courthouse.
If necessary, we may also ask you to provide any letters or documents related to your immigration matter. If you are a youth (age 12 to 17) who has been charged with a crime, you may still be eligible to receive representation by a lawyer through Legal Aid Alberta. For most issues, Legal Aid Alberta lawyers charge a reduced hourly rate of $125.00 plus miscellaneous fees. We can help if you are experiencing family violence and need protection. LAA cannot assist directly with matters where the children have been removed from Alberta and taken to a foreign country. David recently retired from the Alberta Securities Commission after having served over 25 years as its executive director.
If you are an AISH recipient, you are generally considered eligible. However, all clients must have less than $120,000 in equity assets to qualify. If an Emergency Protection Order is granted, you will receive information at the hearing about the protections in place and the date for your mandatory review hearing at the Court of King’s Bench. This review hearing will be scheduled within nine working days from the date the EPO is granted.
After the EPO is Granted
You will participate in a hearing, either in person or by phone, to explain your situation. Duty counsel will help you complete the required EPO application forms. You may be asked to provide identification and any supporting documents or evidence. When you apply, you’ll be asked to provide the name of a preferred lawyer. You can search by court location, area of law or languages spoken to find a Roster lawyer that is right for you.
This includes persons receiving Assured Income for the Severely Handicapped (AISH). Eligibility is best determined by LAA’s Contact Centre Casino Betinwin Intake Officer team. You can apply after Children’s Services has filed a court application or if there is an ongoing court case with Children’s Services. We are not able to provide a lawyer if Children’s Services is wanting to speak with you about an issue, only once they have made a court application.
